“This House unanimously resolves to urge the Government to pass an urgent Ordinance/Corrigendum/Circular or Amendment to facilitate regularization of houses which are constructed under the Twenty Point Programme and have technical deviations which are regularizable under law. The Government can buttress such facilitation by relying on the judgment of the Hon’ble Supreme Court in Syed Muzaffar Ali and Others v. Municipal Corporation of Delhi, wherein the Hon’ble Apex Court has observed that mere departure from the authorized plan or putting up a construction without sanction does not ipso facto and without more necessarily and inevitably justify demolition of the structure. The citizen’s availing the land under Twenty Point Programme for the purpose of constructing their own dwelling house are primarily from the Scheduled Caste, Scheduled Tribe, Other Backward Classes or Economically Weaker Section and the proposed regularization will reassure the purpose of the scheme and its commitment to eradicate poverty and eliminate social and economic disparities. The Twenty Point Programme is a big boost to the society and mere deviations in technicalities should not deviate the intent and purpose behind the genesis of the Twenty Point Programme.

This House resolves that the Government should formulate a policy to provide subsidised fish curry and rice to goans which is the staple diet of Goemkars. The constant and substantial increase in prices of essential commodities and fish is making it extremely difficult for the common Goemkars to make ends meet and thus maintain a wholesome diet. This House further resolves that this subsidised meal be provided through canteens which will be run by organisations such as women self-help groups, so that this programme will also provide an avenue of income for such organisations.”

“This House strongly recommends the Government to enact suitable legislation to encourage the concept of contract farming in the State. There is an urgent requirement to bring large tracts of fallow land under cultivation which can be achieved through contract farming. This will ensure minimizing the economic risk in farming and encourage Goans to revisit agriculture as an economically viable profession and business. It will also provide farmers with economies of scale thus raising their income and ensuring product quality, quantity, and timely delivery.”

Further, the department intends to introduce Smart Meters forcing every consumer to pay without reason, The Government should re-examine both the issues as the government can meet the revenue deficits through alternative means and the Smart Meter installation charge is avoidable and unnecessary. a) whether the Government or any Panchayat has conducted or commissioned carrying capacity studies for villages in Goa before granting permissions for mega residential or commercial projects (having more than 30 units) since 2023; if so, the details thereof, furnish copies of such studies with names of the villages covered and the agencies or consultants engaged;
b) the taluka-wise and village-wise list of all mega projects (multi-dwelling units, large hotels, commercial complexes, etc.) approved or under consideration since 2023, indicating whether a carrying capacity assessment was done prior to approval and the outcome of such assessments;
c) the steps taken by the Government to ensure that Panchayats and the Town and Country Planning Department consider the carrying capacity of villages including infrastructure, water, power, waste management and environmental sustainability before issuing construction licenses for mega projects;
d) whether the Government has received resolutions, representations or demands from Gram Sabhas or Panchayats calling for a moratorium or halt on mega projects until carrying capacity studies are completed; if so, the details thereof, and action taken by the Government in response; and
e) whether the Government has issued any guidelines, notifications, or circulars mandating carrying capacity studies for villages as a prerequisite for approval of mega projects; if so, furnish copies of such orders and details of enforcement and monitoring mechanisms in place?

Answer:- Sir, Village Panchayats has not carried out any carrying capacity studies. Further, the Town and Country Planning Department has also replied that their Department has not came out any carrying capacity studies.

Answer:- So far Panchayats have not taken any such steps, so also, Town and Country Planning Department has reported that there have not taken any such steps as furnished by Town and Country planning Department.

c) the total quantum of grants recommended by the 3rd SFC for Panchayats for the award period 2024-25 to 2028-29, the heads under which these grants are to be disbursed and the criteria for allocation among local bodies;
d) the key challenges and gaps identified by the 3rd SFC in the functioning of local bodies, such as deficits in revenue accounts, lack of financial discipline, and underutilization of grants and the Government’s plan to address these issues; and
e) whether the Government has issued any orders, notifications, or guidelines to implement the recommendations of the 3rd SFC; if so, furnish certified copies of such documents with the current status of its implementation in terms of grant disbursement, capacity-building and monitoring mechanisms for local bodies?

Reply: Yes Sir,The Action Taken report along with the Major Recommendations has been tabled in the Goa State Legislative Assembly on 08.02.2024. The Commission has submitted its Final Report to the Hon’ble Governor of Goa on 28.06.2024 and it is yet to be placed before the cabinet of Ministers for their approval.

Reply:Not yet, as it is under consideration of the Government.

(b) the road works involving bitumen or asphalt as a constituent material, the copy of the letter addressed to a Government-approved laboratory by Goa Industrial Development Corporation for testing the material as per work guidelines, along with all individual laboratory test reports;
(c) the dates on which the hot mix plant was requisitioned for each road work undertaken in these Industrial estates, along with copies of the requisition letter, daily report sheets of work done, dates of measurement as recorded in the Measurement Book and the quantity of work done for each date;
(d) whether any of the above works faced delays, cost overruns, or quality issues; if so, the reasons thereof and details of action taken against the responsible officials or contractors; and
